Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and The Pickle Bullpin LLC ("Pickle Bullpen", "we", "us") governing your access to https://www.picklebullpen.com and all related Services. By creating an account, registering for an event, making a purchase, or otherwise using the Services you accept these Terms, our Privacy Policy (https://www.picklebullpen.com/privacy-policy) and our Return Policy (https://www.picklebullpen.com/return-policy). If you do not agree, do not use the Services.

2. Eligibility & Accounts

• You must be at least 18 years old, or a parent/legal guardian registering and supervising a minor player, and must have the legal capacity to contract.
• You agree to provide accurate, current information (including a working mobile number for tournament communications) and to keep it updated.
• You are responsible for all activity under your account and for keeping your password confidential. One account per person; duplicate or shared accounts may be merged or closed.
• We may suspend or terminate accounts that violate these Terms, applicable law, event rules, or that threaten the integrity, safety or reputation of the Bullpen community.

3. Tournaments, Leagues & Sessions

• Entry fees, divisions, formats, schedules and prize structures are set per event by the Tournament Director (TD) and shown at registration. The TD's decisions on brackets, seeding, court assignments, scoring disputes and conduct are final.
• You must accept the Tournament Liability Waiver presented at registration; you cannot enter an event without it. Participation is at your own risk.
• Refunds for entries are governed by the event's stated policy. Unless the event states otherwise, entries are refundable in full only if we cancel the event; withdrawals after the registration deadline are non-refundable. Weather delays or rescheduling are not cancellations.
• Doubles teams: the registering player is responsible for their partner's eligibility and acceptance of these Terms and the waiver.
• Session bookings and passes are subject to coach approval and the booking terms displayed at purchase.

4. Rankings, Scores & Fair Play

PSI, PBR, tour standings, streaks and movers are computed automatically from recorded results and are published publicly. You consent to the public display of your name, team name, scores, rankings, awards and match photos/video from events you enter. Entering false scores, sandbagging, colluding, impersonating another player, or tampering with scorekeeping devices is prohibited and may result in result reversal, ranking adjustment, forfeiture of prizes, and permanent removal.

5. Pro Shop Purchases

• Prices are in U.S. dollars and may change without notice; the price at checkout governs. Sales tax is calculated per item based on the shipping destination. Service/processing fees and shipping are shown before you pay.
• Card payments are processed by Stripe; by paying you also agree to Stripe's terms. We may cancel orders for suspected fraud, pricing errors, or stock errors with a full refund.
• Returns, refunds and exchanges are governed exclusively by our Return Policy at https://www.picklebullpen.com/return-policy.
• Items offered through third-party "Buy Now" ambassador links are sold by that third party under its own terms.
• Product descriptions and photos are provided in good faith; minor variations in color or packaging are not defects.

6. BULLION Coin (BLC) & Rewards

• BLC is a closed-loop, in-platform credit for use within the Services. It is not legal tender, a security, a cryptocurrency, or a stored-value instrument redeemable for cash, and has no value outside the platform.
• Bonus BLC (including share rewards, promotional credits and lottery/bounty payouts) is promotional, may carry different redemption rates, can be revoked for abuse, and is never refundable or redeemable for cash.
• We may change BLC pricing, fees, redemption rates, bonus programs or discontinue BLC with reasonable notice; unused purchased BLC will be honored for a wind-down period or refunded at our discretion as required by law.
• Referral/share rewards are earned only on genuine purchases by other members through your link; self-referrals, fake accounts or purchase-and-return schemes forfeit rewards.

7. User Content & Media

You retain ownership of photos, videos, profile content, reviews and messages you post ("Content") and grant us a worldwide, royalty-free license to host, display, reproduce and share it in connection with the Services, event coverage, boards, broadcasts and promotion of Pickle Bullpen. You represent you have the rights to post your Content and that it does not infringe others' rights or contain unlawful, harassing, hateful or sexually explicit material. We may remove Content at our discretion. Event photography and live broadcasts may include your likeness; by entering an event you consent to this use.

8. Acceptable Use

• No harassment, threats, discrimination, or unsportsmanlike conduct toward players, TDs, coaches, staff or venues.
• No scraping, bots, reverse engineering, security probing, or interfering with scoring, boards, broadcasts or payments.
• No unauthorized commercial use, resale of entries, or advertising without a Bullpen ad placement agreement.
• No circumventing fees, exploiting bugs, or manipulating BLC, rewards, lotteries or rankings.

9. Intellectual Property

The Pickle Bullpen name, logos, PSI/PBR systems, court boards, designs, software and content are owned by The Pickle Bullpin LLC or its licensors and protected by law. You may not use our marks or copy our systems without written permission. Feedback you give us may be used freely without obligation.

10. Third-Party Services

The Services rely on third parties (Stripe, Twilio, Resend, Cloudinary, Google, Twitch, carriers). We are not responsible for their availability, acts or omissions, and your use of them is subject to their terms.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RANKINGS, SCORES, SCHEDULES, BROADCASTS OR NOTIFICATIONS WILL BE ERROR-FREE OR UNINTERRUPTED. PICKLEBALL IS A PHYSICAL ACTIVITY WITH INHERENT RISK OF INJURY; YOU PARTICIPATE AT YOUR OWN RISK AS SET OUT IN THE EVENT WAIVER.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PICKLE BULLPIN LLC, ITS OWNERS, STAFF, TOURNAMENT DIRECTORS, COACHES AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, RANKINGS OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SPECIFIC ORDER, ENTRY OR BOOKING GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify and hold harmless The Pickle Bullpin LLC and its owners, staff, TDs, coaches and partners from claims, damages and expenses (including reasonable attorneys' fees) arising from your Content, your conduct at events, your violation of these Terms or applicable law, or your infringement of any third party's rights.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim you agree to contact us at admin@picklebullpen.com and attempt in good faith to resolve it within 30 days. Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Charlotte County, Florida, and you consent to their jurisdiction. Where permitted by law, you waive the right to participate in class actions and to a jury trial. Any claim must be filed within one (1) year after it arises.

15. Changes, Termination & General

We may modify these Terms by posting an updated version with a new effective date; continued use constitutes acceptance. We may suspend or discontinue any part of the Services at any time. If any provision is unenforceable, the remainder stays in effect. These Terms, the Privacy Policy, the Return Policy and any event-specific rules and waivers are the entire agreement between you and us.
